End of the legal saga regarding the assessment contestation of a data centre in the Baie-D’Urfé industrial park

The Town of Baie-D’Urfé is pleased to announce the end of the judicial contestation that had been ongoing for more than 10 years concerning the property assessment of a data centre located in the industrial park.

This contestation was prolonged due to multiple appeals, including an unsuccessful request to be heard by the Supreme Court of Canada.

Throughout all these years, the Town was required to set aside significant financial reserves to protect itself in the event of an unfavourable judgment. This meant that the municipal tax revenues paid by this company, which would normally have been used to provide services to the population, were systematically placed in a reserve and had to be accounted for in the preparation of budgets, since these funds were not available.

For this case alone, the accumulated reserve at the end of 2024 had reached $10,662,850.

This represented a considerable burden for the Town and limited its capacity to invest in services and projects for its citizens.

Recently, before the Tribunal administratif du Québec, an official discontinuance brought the contestation to an end. The property value has therefore been confirmed, and the case is now closed.

The accumulated reserve of $10,662,850, which had until now been frozen, can now be released.

For our community, this represents a major gain, since these funds can finally be used to support services and improvements that benefit residents.

The funds will be added to the current year’s revenues and will appear in the 2025 financial statements as a surplus.

It will be up to the next municipal council to determine how these funds will be used for the benefit of the entire community.

The municipal council is pleased to finally be able to turn this page and put an end to the accumulation of such a heavy financial reserve.
